Welcome to the Consistray Terms of Use agreement. For purposes of this agreement, "Site" refers to the Company's website, which can be accessed at consistray.in. "Service" refers to the Company's services accessed via the Site, in which users can use our services. The terms "we," "us," and "our" refer to the Company. "You" refers to you, as a user of our Site or our Service.

1. Acceptance

By accessing or using Consistray's TTS platform at consistray.in ("Service"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please discontinue use immediately. These Terms constitute a legally binding agreement under the Indian Contract Act, 1872.

2. Eligibility

You must be at least 13 years of age and competent to contract under the Indian Contract Act, 1872. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Subscriptions & Payments

Paid plans are billed on a recurring cycle in Indian Rupees (INR) inclusive of applicable GST. All payments are processed securely by Razorpay. Fees are non-refundable except as required by law. We reserve the right to revise pricing with 30 days' advance notice. Non-payment may result in suspension or termination. GST invoices will be issued as required.

5. Acceptable Use

You agree not to use the Service to:

Generate speech that impersonates any real person without their explicit consent (voice cloning / deepfakes)
Produce content that is defamatory, obscene, seditious, or in violation of the Information Technology Act, 2000 or any other applicable Indian law
Circumvent API rate limits or engage in abusive usage patterns
Resell, sublicense, or white-label access without our prior written consent
Use TTS output to train competing AI or TTS models without a separate written agreement
Infringe the intellectual property rights of any third party
Spread misinformation or content prohibited under Indian law

6. Intellectual Property

You retain ownership of the text you submit. You grant Consistray a limited, non-exclusive, royalty-free licence to process it solely to deliver the Service. Generated audio output is licensed to you per your plan. All platform software, AI models, brand assets, and documentation are protected under the Copyright Act, 1957 and Trade Marks Act, 1999.

7. Termination

We may suspend or terminate your account without prior notice for violation of these Terms, non-payment, or to comply with applicable law. You may cancel at any time via your dashboard. Upon termination, your data will be handled per our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by Indian law, Consistray shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed fees paid by you in the 3 months immediately preceding the claim.

9. Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Disputes shall first be attempted to be resolved through good-faith negotiation within 30 days. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts at Alipurduar, West Bengal, India.

11. Changes to Terms

We may update these Terms at any time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use constitutes acceptance.
